PUBLIC AGREEMENT
For Organising Events and Selling Tickets for Events
This Service Agreement is an official OFFER (public offer) (the “Offer/Agreement”) made by [YOUR COMPANY / SOLE PROPRIETORSHIP NAME] (the “Operator”). It is drafted pursuant to Articles 389 and 395 of the Civil Code of the Republic of Kazakhstan and contains all essential terms for the provision of services by the Operator.
In accordance with Clause 3 of Article 396 of the Civil Code of the Republic of Kazakhstan, if a legal entity and/or individual accepts the terms set out below, such person, by performing the acceptance of this Offer, becomes the “Buyer”.
1. TERMS AND DEFINITIONS
Acceptance — the Buyer’s acceptance of the Offer by clicking the button “I agree with the terms of the Agreement” on the Operator’s Website.
Cancellation — cancellation of the Order and returning the Tickets ordered by the Buyer to open sale in accordance with this Offer.
Ticket — a document confirming the Buyer’s right to attend the Event, issued by the Operator in paper form or electronically.
Order — one or more Tickets selected by the Buyer and combined in the System under a single identification number.
Event — the event specified in the Ticket.
Place of conclusion of the Offer/Agreement — the city of ____________________.
Face value of the Ticket — the price of admission to the Event established by the Operator for all Buyers or for specific categories of Buyers indicated on the Website.
Operator — [YOUR COMPANY / SOLE PROPRIETORSHIP NAME], acting as the organiser of the Event / official ticketing operator for the Event.
Offer — a public paid services agreement concluded on the terms of this Offer in connection with the Event, under which the Operator organises the Event and sells Tickets to the Buyer.
Purchase confirmation — a document sent by the Operator to the Buyer upon the purchase of a Ticket.
Buyer — an individual or legal entity purchasing a Ticket for the Event.
Applicable law — the legislation of the Republic of Kazakhstan.
Website — the website in the Internet located at: ____________________ (URL), administered by the Operator.
System — the software and hardware complex used by the Operator for ticket sales and supporting such sales.
E-ticket — an electronic document sent to the Buyer and printed by the Buyer independently.
2. GENERAL PROVISIONS
2.1 This Offer governs the terms and procedure for holding the Event and selling Tickets by the Operator to the Buyer, and the contractual rights and obligations arising between the Operator and the Buyer.
2.2 Tickets are sold exclusively under this Offer and only if the Buyer fully and unconditionally accepts it. Partial acceptance or acceptance on other terms is not permitted.
2.3 Using the Operator’s services under this Offer confirms the Buyer’s full acceptance via Acceptance.
2.4 For purchasing Tickets, Buyers pay using any payment methods agreed with the Operator and not prohibited by the laws of the Republic of Kazakhstan.
2.5 Tickets are sold for personal use only and not for entrepreneurial purposes. The Buyer agrees not to use Tickets for advertising goods/services of the Buyer or third parties, and not to resell Tickets to third parties regardless of resale price.
2.6 Tickets that have been sold may not be returned, and refusal to perform the Agreement is not accepted due to disagreement with this Offer after Acceptance. Refunds are possible only in accordance with the procedure and terms set out in this Offer.
2.7 This Offer fully applies to Buyers purchasing Tickets through the Website.
3. SUBJECT OF THE OFFER
3.1 The subject of this Offer is:
3.1.1 Holding the Event on the terms indicated on the Website;
3.1.2 Providing the Buyer with services for reserving and selling Tickets for the Event.
4. ACCEPTANCE PROCEDURE
4.1 Before performing Acceptance, the Buyer confirms that they have read and understood this Offer and all mandatory rules referenced in it.
4.2 The Buyer confirms that actions (or inaction) of the Buyer’s representative(s) are performed with the Buyer’s knowledge and in the Buyer’s interests. The Operator is not responsible for such actions (or inaction).
4.3 Acceptance may be performed by purchasing Tickets through the Website.
4.4 Actions described in this Section 4 constitute full and unconditional acceptance of this Offer and are equivalent to entering into a written agreement under applicable law.
4.5 Ticket purchase through the Website is performed by the Buyer in the following steps:
4.5.1 Visiting the Website and registering by providing the Buyer’s details;
4.5.2 Paying for the Ticket in the manner specified in this Offer;
4.5.3 Receiving the Ticket to the email address provided during registration/purchase.
4.6 If a Ticket is reserved online and not paid within 48 (forty‑eight) hours from the reservation time, the Agreement terminates and the reservation is cancelled.
4.7 When purchasing at a physical point of sale, payment is made on-site.
4.8 Ticket sales through the Website for a specific Event date close at ____:____ (local time, city ____________________) on the day preceding the Event date.
4.9 The Operator sets the start/end dates of ticket sales, ticket categories, and sales channels (Website, points of sale). This information is posted on the Website and/or points of sale and may be communicated via the Operator’s contact centre.
4.10 For certain dates/categories, only specific ticket forms may be available (e-ticket or paper ticket).
4.11 The start date of ticket sales is determined by the Operator and published on the Website.
5. RIGHTS AND OBLIGATIONS OF THE PARTIES
5.1 The Buyer has the right to obtain information about ticket prices, categories, and related services from open sources and decide whether to purchase Tickets by accepting this Offer or refusing to do so.
5.2 The Buyer has the right to receive information about ticket sales rules, available categories/forms of Tickets, and other Event information available to the Operator via the Website, telephone, and other methods indicated on the Website.
5.3 The Buyer chooses a payment method from those specified in this Offer and is responsible for reviewing the payment rules for the selected method.
5.4 The Buyer may send feedback to the Operator using the contact details on the Website.
5.5 The Buyer must: (i) read and accept this Offer and Event rules; (ii) follow this Offer; (iii) pay the full Ticket price before receiving the Ticket; (iv) ensure access to the Website and functioning email services; (v) check Ticket details and promptly report errors; (vi) print the e-ticket after full payment and ensure print quality; (vii) bring a paper ticket and an ID document to the Event; (viii) protect the Ticket from copying — entry will be granted to the Ticket presented first.
5.6 The Operator has the right to refuse services if the Buyer does not fully accept the Offer; to require compliance; to maintain/modify Website software; to require proper payment; to cancel an Order in cases described herein (including incorrect/false data); and to amend this Offer unilaterally.
5.7 The Operator must provide the Buyer with complete and sufficient information about the Event, organiser, Operator, and ticket purchase/receipt instructions, primarily via information on the Website/points of sale/contact centre, and must use personal data only in accordance with this Offer and applicable law.
6. PAYMENT PROCEDURE
6.1 A Ticket is not issued (sent) to the Buyer until it is fully paid.
6.2 The Buyer may pay using methods allowed by the Operator and specified on the Website and/or in this Offer.
6.3 Payment methods may include (non-exhaustive):
6.3.1 Cashless payment by bank card (Visa, MasterCard, etc.);
6.3.2 Cash payment at points of sale (if applicable).
6.4 The Buyer’s payment obligation is deemed fulfilled when funds are credited to the Operator’s bank account.
6.5 When paying by card, the Buyer must use a card issued in the Buyer’s name or have duly confirmed authorisation to use a third party’s card. The Operator may request ID verification.
7. REFUNDS
7.1 Ticket returns and refunds are processed by the Operator unless otherwise agreed between the Operator and the organiser and stated on the Website.
7.2 Only genuine Tickets purchased from the Operator (Website or points of sale) are eligible for refund consideration. Tickets with physical damage may require authenticity verification.
7.3 If the Ticket was paid cashlessly, refunds (when applicable) are made by transfer to the bank account specified by the Buyer. If paid in cash, refunds are made at the point of sale indicated on the Website (if applicable).
7.4 Refunds are processed within 10 (ten) calendar days from receipt of the Buyer’s request by the Operator’s support service (unless otherwise required by law).
7.5 In case of cancellation, replacement, or rescheduling of the Event (including full/partial closure on dates covered by the Ticket), the Buyer is refunded the Ticket face value.
7.6 No refunds are provided for lost, damaged, or unused Tickets.
7.7 Official information about cancellation/replacement/rescheduling is the information published on the Website and at points of sale.
7.8 The Buyer confirms that refund rules and grounds have been fully explained and are understood.
7.9 Tickets must be returned no later than 24 hours before the Event (unless otherwise required by law).
8. LIABILITY
8.1 The Parties are liable for non-performance or improper performance in accordance with the laws of the Republic of Kazakhstan and/or this Offer.
8.2 The Operator’s liability to the Buyer is limited to the scope of ticket reservation/issuance/sale services.
8.3 The Buyer bears risks related to errors/inaccuracies in data provided for Ticket issuance.
8.4 The Operator is not liable for Buyer’s losses resulting from misunderstanding of the ticket purchase/receipt/attendance procedure.
8.5 The Buyer acknowledges that on certain days restricted-access events may occur within the overall Event programme; this does not constitute a breach of Buyer’s rights.
9. FORCE MAJEURE
9.1 The Parties are released from liability for non-performance during force majeure circumstances, i.e., extraordinary and unavoidable events preventing performance of obligations.
10. INTELLECTUAL PROPERTY
10.1 Exclusive rights to intellectual property (texts, images, videos, software, trademarks, etc.) published on the Website and related materials belong to the Operator and/or its partners. No licence is granted to the Buyer unless expressly stated.
10.2 Links to third-party websites do not imply endorsement. The Operator is not responsible for third-party content.
10.3 Audio/video/photo recording at the Event is permitted only as allowed by the organiser. Violations may lead to liability under applicable law.
11. DISPUTE RESOLUTION
11.1 Disputes are to be resolved through a pre-trial (claims) procedure. The complaining Party submits a written claim with supporting documents. The response period is 10 (ten) business days.
11.2 If no resolution is reached within 60 (sixty) calendar days, the dispute shall be considered by the competent court under the laws of the Republic of Kazakhstan.
12. EFFECTIVE DATE AND AMENDMENTS
12.1 This Offer enters into force from the moment it is posted on the Website and remains effective (for ticket sales) until the end of the Event.
12.2 The Operator may amend this Offer at any time by publishing the updated version on the Website. Amendments do not apply to Tickets already purchased before the amendment date, unless mandatory law requires otherwise.
13. PERSONAL DATA
13.1 By accepting this Offer, the Buyer consents to the collection and processing of personal data by the Operator for the purposes of ticket purchase and Event organisation.
13.2 Data may include: full name, phone number, city/country, email address, and other information necessary for service provision.
13.3 Processing is carried out in accordance with the laws of the Republic of Kazakhstan and may include collection, storage, updating, use, anonymisation, blocking, and deletion, including automated processing.
13.4 The Buyer may exercise data protection rights by submitting a request to the Operator via the email/contact details specified on the Website.
14. FINAL PROVISIONS
14.1 In addition to this Offer, the Buyer must comply with Event entry and conduct rules published by the organiser on the Website. Acceptance of this Offer confirms the Buyer’s informed consent to such rules.
14.2 Any matters not covered herein are governed by the laws of the Republic of Kazakhstan. The applicable law is the law of the Republic of Kazakhstan.
